Ni un s\u00ed ni un no.<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Escribe: Abogada Valeria Montenegro<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Es una situaci\u00f3n que se repite todos los d\u00edas: una jubilaci\u00f3n o una pensi\u00f3n que no sale, un reclamo presentado ante un organismo p\u00fablico que queda cajoneado. Mientras tanto, la persona espera y el tiempo corre en su contra.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lo que muchos no saben es que la Administraci\u00f3n P\u00fablica tiene la obligaci\u00f3n de responder, y que la ley prev\u00e9 una herramienta concreta para cuando no lo hace: el amparo por mora.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00bfQu\u00e9 es el amparo por mora?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Es una acci\u00f3n judicial que se presenta cuando un organismo p\u00fablico deja vencer los plazos que tiene para resolver un tr\u00e1mite y no se pronuncia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A nivel nacional est\u00e1 previsto en el art\u00edculo 28 de la Ley 19.549 de Procedimientos Administrativos. En la Provincia de C\u00f3rdoba, para los organismos provinciales, rige la Ley 8508.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dicho en simple: el juez no decide si ten\u00e9s raz\u00f3n o no en tu reclamo. Lo que hace es ordenarle al organismo que te responda dentro de un plazo. Y si no hay un plazo fijado para ese tr\u00e1mite en particular, cuando la demora ya excede lo razonable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00bfY si el problema es con mi prepaga u obra social?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ac\u00e1 hay una confusi\u00f3n muy com\u00fan. El amparo por mora sirve frente al Estado y sus organismos. Sin esas pruebas, cualquier reclamo posterior se complica.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Si el plazo ya venci\u00f3 y no ten\u00e9s respuesta, no te quedes esperando indefinidamente.
