En paralelo, modific\u00f3 por decreto la ley previsional profundizando los diferentes tratamientos entre sexos. Estas decisiones son contradictorias y muy improvisadas. Casi inmediatamente aparecieron los primeros rechazos y con el tiempo se producir\u00e1n enormes costos.<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Informe: Idesa<\/strong><\/p>\n\n\n\n<p>El gobierno nacional dict\u00f3 un Decreto de Necesidad de Urgencia (DNU) modificando par\u00e1metros del sistema previsional. La norma tiene 75 considerandos y se public\u00f3 un s\u00e1bado, posiblemente tratando de disimular la irregularidad de modificar reglas estructurales del sistema previsional con un instrumento legal endeble.<\/p>\n\n\n\n<p>Concretamente, el DNU establece que se reconocer\u00e1 1 a\u00f1o de servicio jubilatorio a las mujeres por cada hijo nacido vivo. Si el hijo es adoptado se reconocer\u00e1n 2 a\u00f1os de servicios. Si la mujer adem\u00e1s cobr\u00f3 durante al menos un a\u00f1o la Asignaci\u00f3n Universal por Hijo (AUH) suma 2 a\u00f1os m\u00e1s de servicios a los que les corresponda.<\/p>\n\n\n\n<p>El objetivo es compensar la inequidad que se produce cuando las mujeres dejan de acumular aportes previsionales debido a que se retiran del mercado laboral por la maternidad.<\/p>\n\n\n\n<p>No hay discusi\u00f3n en torno a que las normas previsionales tienen que reconocer a\u00f1os por los hijos. Por diversas v\u00edas en todos los pa\u00edses desarrollados es un tema que se tiene en cuenta. La duda es si el dise\u00f1o que estipul\u00f3 el gobierno argentino ser\u00e1 efectivo.<\/p>\n\n\n\n<p>En este sentido, seg\u00fan informaci\u00f3n publicada por la Secretar\u00eda de Seguridad Social, entre los a\u00f1os 2018 y 2020 se jubilaron unas 286 mil mujeres de las cuales:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>El 83% accedi\u00f3 al beneficio sin cumplir con el m\u00ednimo de 30 a\u00f1os de aportes gracias a las Moratorias.<\/li><li>De estas mujeres, aproximadamente el 8% se jubil\u00f3 con m\u00e1s de 20 a\u00f1os de aportes \u201ccomprando\u201d a\u00f1os de servicios con las Moratorias.<\/li><li>El 92% restante se jubil\u00f3 con menos de 20 a\u00f1os de aportes \u201ccomprando\u201d el resto con las Moratorias.<\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img data-recalc-dims=\"1\" fetchpriority=\"high\" decoding=\"async\" width=\"741\" height=\"356\" src=\"https:\/\/i0.wp.com\/elregionalvm.com.ar\/noticias-villa-maria\/wp-content\/uploads\/2021\/07\/Anos-de-servicios-de-mujeres-jubiladas.jpg?resize=741%2C356&#038;ssl=1\" alt=\"\" class=\"wp-image-41525\" srcset=\"https:\/\/i0.wp.com\/elregionalvm.com.ar\/noticias-villa-maria\/wp-content\/uploads\/2021\/07\/Anos-de-servicios-de-mujeres-jubiladas.jpg?w=741&amp;ssl=1 741w, https:\/\/i0.wp.com\/elregionalvm.com.ar\/noticias-villa-maria\/wp-content\/uploads\/2021\/07\/Anos-de-servicios-de-mujeres-jubiladas.jpg?resize=300%2C144&amp;ssl=1 300w\" sizes=\"(max-width: 741px) 100vw, 741px\" \/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Estos datos muestran que la mayor\u00eda de las mujeres llegan a la edad de retiro con muy pocos a\u00f1os de aportes. Por lo tanto, reconocer 1 o 2 a\u00f1os de aportes por hijo no les cambiar\u00e1 la situaci\u00f3n ya que de todas formas no llegar\u00e1n a los 30 a\u00f1os de aportes que exige la normativa previsional actual. El DNU termina siendo un anuncio muy ostentoso frente a la degradada situaci\u00f3n laboral que sufren las mujeres.<\/p>\n\n\n\n<p><strong>La X no soluciona el problema<\/strong><\/p>\n\n\n\n<p>En paralelo, el gobierno anunci\u00f3 que los documentos de identidad deben llevar una marca \u201cX\u201d cuando la persona no se reconozca en el sexo femenino o masculino. Esto implica que las personas que no desean definir su sexo tendr\u00e1n que gestionar ante el Registro Civil una nueva partida de nacimiento y con ella solicitar el cambio de DNI. Se trata de un tr\u00e1mite que llevar\u00e1 mucho tiempo y esfuerzo instrumentar.<\/p>\n\n\n\n<p>Aun suponiendo profesionalidad y rapidez, igualmente resultar\u00e1 costoso, burocr\u00e1tico y poco emp\u00e1tico para las personas involucradas. Esto es lo que subyace en el intempestivo planteo que uno de los \u201cbeneficiados\u201d con la \u201cX\u201d que participaba del anuncio oficial le hizo al Presidente.<\/p>\n\n\n\n<p>Las formas y los dise\u00f1os con que se instrumentaron el reconocimiento previsional por hijo y la identidad no binaria desnudan mucha improvisaci\u00f3n. M\u00e1s sensato y eficaz seria eliminar la distinci\u00f3n de sexos en la identidad. Es decir, disponer que el DNI no defina sexo y unificar la edad jubilatoria para que todas las personas se jubilen a los 65 a\u00f1os. Para que el reconocimiento de a\u00f1os de servicio por hijo sea efectivo, hay que establecer que el haber previsional sea proporcional a los a\u00f1os de aportes realizados (es decir, flexibilizar el r\u00edgido requisito actual de 30 a\u00f1os de aportes como m\u00ednimo).<\/p>\n\n\n\n<p>De esta forma, no habr\u00e1 distinciones de sexo y habr\u00e1 un efectivo reconocimiento jubilatorio a las personas que tuvieron y\/o criaron hijos.<\/p>\n\n\n\n<p>La improvisaci\u00f3n en pol\u00edtica p\u00fablica tiene altos costos sociales. La identificaci\u00f3n con la \u201cX\u201d no soluciona la problem\u00e1tica de los que no quieren reconocer sexo. El DNU modificando la ley previsional no resuelve la problem\u00e1tica de la falta de reconocimiento por hijos y agrega inseguridad jur\u00eddica. En paralelo se agregan nuevas fuentes de conflicto y discrecionalidad.<\/p>\n\n\n\n<p>Por ejemplo, cuando se presente una persona a jubilarse con una \u201cX\u201d en su DNI, \u00bfSe aplicar\u00e1 los 65 a\u00f1os como los varones, los 60 a\u00f1os como las mujeres o se partir\u00e1n las diferencias en 62 a\u00f1os y 6 meses?<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><em>Fuente: Idesa <\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>El gobierno present\u00f3 el documento no binario.
